Fikir ve sanat eserlerinin rehne konu edilmesi: Hukuki bir inceleme

Özet
Taşınır rehni, temlike elverişli ve ekonomik değeri haiz taşınır eşya, hak veya alacak üzerinde kurulan, borcun ifa edilmemesi halinde rehin alacaklısına teminat konusunun paraya çevrilmesini talep etme ve bu yolla alacağını tahsil etme yetkisi tanıyan sınırlı ayni hak olarak tanımlanmaktadır. Bu çerçevede, fikir ve sanat eserleri ile bu eserler üzerindeki hakların temlike elverişli olması ve ekonomik değer taşımaları halinde teminat olarak gösterilmesi mümkün hale gelmektedir. Fikir ve Sanat Eserleri Kanunu uyarınca; sinema eserleri, alenileşmiş bir eserin müsvedde veya aslı, yayımlanmış eserin çoğaltılmış nüshaları, alenileşmiş eser üzerindeki mali haklar ve mali haklara dair hukuki işlemlerden doğan para alacakları, rehin hakkının konusu olabileceklerdir. Buna karşılık; eser sahibinin veya mirasçılardan birinin mülkiyetinde bulunan, henüz alenileşmemiş bir eserin müsvedde veya asılları, alenileşmemiş eserler üzerindeki mali haklar ve bu haklara dair hukuki işlemlerden doğan ve paraya ilişkin olmayan alacaklar, rehin hakkının konusunu oluşturamayacaktır. Her ne kadar FSEK’te rehne konu olabilecek ve olamayacak unsurlar açıkça düzenlenmiş ise de bu unsurların rehnine ilişkin şartlara ve rehnin hüküm ve sonuçlarına yer verilmemiştir. Bundan dolayı söz konusu unsurların rehninde Türk Medeni Kanunu ve Ticari İşlemlerde Taşınır Rehni Kanunu hükümleri uygulama alanı bulacaktır. Bu çalışmada, fikir ve sanat eserleri ile bu eserler üzerindeki hakların rehni ve rehne konu olmaları halinde ortaya çıkan hukuki problemler, ilgili mevzuat hükümleri kapsamında ele alınmaktadır.
A movable pledge is defined as a limited real right established on movable property, rights, or receivables that are suitable for pledge and have economic value, which grants the pledgee the right to demand the conversion of the collateral into cash and collect their receivables in this manner in the event of non-performance of the debt. Within this framework, intellectual and artistic works and the rights over such works may be used as collateral if they are suitable for pledge and have economic value. Pursuant to the Intellectual and Artistic Works Law, cinematographic works, drafts or originals of published works, copies of published works, financial rights over published works, and monetary claims arising from legal transactions related to financial rights may be subject to a pledge. On the other hand, drafts or originals of works that have not yet been made public, which are owned by the author or one of the heirs, financial rights over works that have not been made public, and claims arising from legal transactions related to these rights that are not monetary in nature cannot be subject to a pledge. Although the elements that may or may not be subject to a pledge are explicitly regulated in the Copyright Law, the conditions for pledging these elements and the provisions and consequences of the pledge are not addressed. For this reason, the provisions of the Turkish Civil Code and the Law on Movable Pledges in Commercial Transactions will apply to the pledging of the aforementioned items. This study will address the legal issues arising from the pledging of intellectual and artistic works and the rights to such works, as well as their eligibility for pledging, within the scope of the relevant legislation.
