| dc.description.abstract | Bu çalışma sahipli ve sahipsiz hayvanların ceza hukuku bakımından hukuki değerinin tespitini konu edinmektedir. Bu doğrultuda ayrıca hayvanların hukuki değer olarak doğrudan mı yoksa suçun maddi konusu olarak dolaylı mı korunduğu ayrımına da dikkat çekilmeye çalışılmıştır. Hukuki değerin tespitinde yalnızca pozitif hukuktaki düzenlemeler dikkate alınmış olup konu deskriptif olarak ortaya konulmuştur. Bu bağlamda hayvanların bizatihi kendi değerinden dolayı korunmadığı, dolayısıyla ekolojik bir hukuki değer yaklaşımının benimsenmediği, buna karşın hayvanların insanlara faydaları nedeniyle korunduğu ve bunun antroposantrik bir değer yaklaşımını ifade ettiği tespit edilmiştir. Olan hukuka ilişkin bu tespitlerin yanı sıra olması gereken hukuka yönelik düşüncelere çalışmanın değerlendirme ve sonuç kısmında yer verilmiştir. | |
| dc.description.abstract | This paper deals with ascertaining the legal good of the pet and stray animals in the sense of criminal law. Doing so, effort is given to the distinction between the protection of animals as a legal good and as an object of crime. Ascertaining the legal good is based on the positive law documents, therefore it is descriptive. In this sense, the finding of this paper is that the animals are not protected for their own interests, excluding the ecological approach, but rather for the interests of individuals adopting an anthropocentric approach. In addition to this finding with regards to de lege lata, considerations on de lege feranda are made in the conclusion section. | |
