Covid-19 pandemisinin Türk sosyal güvenlik hukuku açısından güncel değerlendirilmesi

Abstract

Covid-19 Pandemisinin ortaya çıktığı ilk günlerden beri sigortalının çalışırken veya çalışma koşulları nedeniyle enfekte olması durumunda yararlanacağı sigorta kolunun tespiti gerek öğreti gerekse uygulamada farklı görüşlerin ortaya çıkmasına yol açmıştır. Zira bu hastalık niteliği gereği toplumun geneli bakımından risk oluşturmakla birlikte, belirli meslek grupları veya belirli işyerlerinde çalışanlar bakımından daha yüksek risk oluşturabilmektedir. Bununla birlikte, virüsün ne zaman, nerede ve kimden bulaştığının tespiti güçtür. ILO tarafından meslek hastalığı yahut iş kazası olarak tanınması tavsiye edilmiş, farklı sosyal güvenlik sistemlerinde farklı sigorta kolları kapsamında değerlendirilmiştir. Sigortalı bakımından Covid-19’un hastalık, iş kazası veya meslek hastalığı sigorta kollarından hangisi kapsamında değerlendirileceği gerek yararlanma koşulları gerekse sağlanacak yardımlar bakımından önem taşımaktadır. Ülkemizde konuya ilişkin özel bir düzenleme yapılmamış olup çeşitli idari işlemler ve kararlarla problem çözümlenmeye çalışılmıştır. Ancak, kanaatimizce yeterli bir çözüm sunulmadığı gibi yeni tartışmalar da gündeme gelmiştir. Çalışmamızda öncelikle söz konusu idari işlem ve kararlara yer verilerek güncel durum tespit edilmeye çalışılacak, ardından öğretideki görüşler ve karşılaştırmalı hukuktan da yararlanılarak, görüş ve tespitlerimize yer verilecektir.

Since the beginning of the Covid-19 Pandemic, the qualification of the social insurance branch that the insured person will benefit, in case of being infected while working or due to working conditions, has created various views both in doctrine and practice. Because, due to its nature, Covid-19 Pandemic generates a risk for the society in general, but it may generate a higher risk for certain occupational groups and employees. However, it is difficult to find out when, where and who contaminated the insured person. It has been recommended to be recognized as an occupational disease or occupational accident by the ILO, and it has been evaluated within the scope of different social insurance branches in different social security systems. For the insured person, which of the social insurance branches Covid-19 will be considered within the scope of sickness, occupational accident or occupational disease is important in terms of both the conditions of benefit and the benefits to be provided. No special regulation has been made on the subject, and the problem has been tried to be solved by several administrative acts and decisions in Turkey. According to our opinion, a satisfying solution has not been provided, and therefore new discussions come to the fore. In our study, first, the current situation will be determined by referencing the mentioned administrative acts and decisions, then our views and evaluations will be presented by referring the views in the doctrine and comparative law.
