Hukuki boyutuyla slot uygulamaları

Abstract

Uçuş teknolojilerinin ve havacılık sektörünün gelişmesiyle birlikte sivil hava taşımacılığı tüm dünyada süratle kullanılmaya başlanmıştır. Dünya çapında yükselen trend, havaalanı iniş-kalkışlarının ve trafik hizmetlerinin hızla yoğunlaşmasına neden olmuştur. Bu yoğunlaşmaya binaen, uçuş hizmetlerine ilişkin artan ihtiyaçların tüm aktörler göz önünde bulundurularak adilane yöntemlerle giderilmesi ihtiyacı ortaya çıkmıştır. Bu sebeple havaalanlarındaki kapasite yoğunluğunu düzenlemek ve havayolu işletmelerinin yoğun trafiğe sahip havaalanları altyapısından adil bir biçimde yararlanabilmesi sağlamak amacıyla yeni bir sistem oluşturulması düşünülmüştür. Slot uygulamaları adı verilen sistem, yoğun havaalanlarından ortak kurallar çerçevesinde iniş ve kalkış yapabilmesi için gerekli olan izni tanımlamaktadır. Bu uygulama kapsamında, trafiği yoğun havaalanları için küresel, bölgesel, ticari iş birliği ve yerel hukuk düzenlemeleri temelinde; rekabetin korunduğu, şeffaf ve erişilebilir bir piyasa oluşturulmak istenmiştir. Ülkemizde de benzer bir eğilimle, yoğun havalimanları için slot rejimi öngörülmüş ve bazı hukuki düzenlemeler yapılmıştır. Bu çalışmada; slot uygulamalarına ilişkin kavramlardan, uluslararası iş birliği çerçevesinde gelişen uygulama prensiplerinden, slot uygulamalarının evrensel, bölgesel, yerel düzenlemelerinden bahsedilerek, mevcut slot uygulamaları ortaya koyulacak ve ülkemizdeki işleyiş mukayeseli bir biçimde değerlendirilmeye çalışılacaktır.

As a result of the development of flight technologies and the aviation industry, civil air transport has been used rapidly all over the world. This rising trend around the world has caused the rapid congestion of airport landings and take-offs and traffic services. Due to this congestion, the need to meet the increasing needs for flight services through fair methods has emerged, taking all actors into consideration. For this reason, it has been planned to create a new order in order to regulate the capacity density at airports and to ensure that airline operators can benefit from the infrastructure of airports with heavy traffic fairly. The system called slot allocation defines the required permission for airline operators to take off from busy airports within the framework of common rules. Within the scope of this application, on the basis of global, regional, commercial cooperation and local legal regulations; It is aimed to create a transparent and accessible market where competition is protected. With a similar tendency in Turkey, the slot regime was envisaged for congested airports and some legal regulations were made. In this study; By mentioning the concepts related to slot applications, the application principles developed within the framework of international cooperation, the universal, regional and local regulations of slot applications, the existing slot applications will be revealed and the operation in Turkey will be evaluated in a comparative manner.
