Özet
Bu tez, gu¨nu¨mu¨zde daha çok ''Helâller ve Haramlar'' şeklinde ifade edilen ''İstihsân ve Kerâhiyye'' başlığının tarihi gelişim su¨recini ve özellikle önemli fetvâ kitaplarından biri olan el-Fetâva't-Tatarhâniyye'deki bu bölu¨mu¨n tahlilini konu edinmektedir. el-Fetâva't-Tatarhâniyye, yararlandığı kaynaklar ve kendisinden sonra çokça atıf alması itibari ile önemli bir noktada bulunduğundan detaylı bir incelemeyi gerektirmiştir. Tezimizin amacı, çok hacimli bir eser olan el-Fetâva't-Tatarhâniyye'nin İstihsân ve Kerâhiyye başlığı altında ne tu¨r fetvâlara yer verildiğini tespit etmek, konu yelpazesini belirlemek, yeni fıkhî olaylara dönem itibari ile nasıl yaklaşıldığını gösterip sonraki dönemlere etkisini ortaya koymaktır. Bir giriş, u¨ç ana bölu¨m ve bir sonuçtan oluşan tezin giriş bölu¨mu¨, tezimizin konusu ve önemi, kapsamı ve yöntemi, literatu¨r değerlendirmesi ve tezin literatu¨re katkısına temas edilmiştir. Birinci bölu¨mde el-Fetâva't-Tatarhâniyye mu¨ellifi, telif edildiği dönem, telif su¨reci ve u¨zerine yapılmış çalışmalar hakkında bilgiler verilmiştir. İkinci bölu¨mde İstihsân ve Kerâhiyye bölu¨m başlığının tarihi gelişim seyri, bu bölu¨mde atıf yapılan eserler, isimler ve bölu¨mu¨n sistematiği olmak u¨zere genel durumu incelenmiştir. Üçu¨ncu¨ bölu¨mde ise el-Fetâva't-Tatarhâniyye, İstihsân ve Kerâhiyye özelinde tahlil edilmiştir. Çalışmamızın çıktıları ise sonuç bölu¨mu¨nde aktarılmıştır.
This thesis deals with the historical development process of the chapter of "Istihsan and Karahiyyah", which is mostly expressed as "Halal and Haram" today, and especially the analysis of this section in al-Fatâwâ al-Tatarkhaniyyah, one of the most influential fatwa books. al-Fatâwâ al-Tatarkhaniyyah required a detailed examination since it stands in an important point in terms of the sources it has benefited and the many references cited it. This thesis aims at discovering the typology of fatwas included in the chapter of Istihsan and Karahiyyah in al-Fatâwâ al-Tatarkhaniyyah, which is a very voluminous work, revealing the range of subject diversity, presenting how it was approached to new fiqh issues and its impact. The introduction part of the thesis, which consists of a presentation, three main chapters and a conclusion, explains briefly the subject and its significance, its scope and method, literature review and the contribution of the thesis to the literature. The first chapter introduces the author of al-Fatâwâ al-Tatarkhaniyyah, the period when it was copyrighted, the copyright process and the studies on it. The second part examines the historical development of the title of Istihsan and Karahiyyah, the works which are referred to in the chapter, the names and the structure of the chapter. The third chapter analyzes al-Fatâwâ al-Tatarkhaniyyah with special reference to Istihsân and Kerâhiyye. The outputs of this study are given in the conclusion part.
