Köklü bir geçmişe sahip olan İslami İlimler, güçlü bir gelenek oluşturmuştur. Bu gelenek içerisinde, akıl ile vahiy, fizik ile metafizik arasında uyum sağlanmıştır. Ne var ki modern dönemde bu uyum bozulduğu için daha önce var olmayan dinî , hukukî, itikadî, sosyal, psikolojik vb. pek çok problemle karşılaşılmıştır. Bu problemlere çözüm üretilmesi, din ile dünya arasındaki uyum ve yakınlaşmanın yeniden tesisini gerektirmektedir. Bu da İslami ilimlerde nitelikli çalışmalar yapmakla mümkündür.

    This article discusses the normative and descriptive aspects of the physician’s juristic role and responsibilities according to Islamic law. In discussing the normative aspect of the physician’s juristic role in Islamic bioethics, one must first distinguish the juridical aspect of Islamic bioethics from bioethical views of Muslims. While the juridical aspect of Islamic bioethics is based upon the SharTah, the divine law revealed to the Prophet Muhammad, and the hermeneutic principles established to study and apply its norms and commands to concrete situations, bioethical views of Muslims may not necessarily be based upon this revelation. It is therefore possible for a Muslim physician to view the role of the physician based on bioethical opinions formulated by non-Muslims without referring to revelation.

    The following represents an overview of the ethico-legal aspects of induced abortion from the perspective of the classical ?anaf? School of Islamic law. The school considers abortion to be a sin and a crime after the clear manifestation of the creation of the human being in the womb. While some ?anaf? jurists take clear manifestation of creation to refer to ensoulment (120 days postconception based on the interpretation of a ?ad?th), others take it to refer to the physical formation of the fetus. Prior to the manifestation of creation, there is considerable legal diversity within the school concerning the ethico-legal status of induced abortion. This chapter examines the ethico-legal perspectives on induced abortion within the ?anaf? School of Islamic law. The presentation is purely academic and hence does not constitute a fatw?. Since the ?anaf? School is the largest school of Islamic law, and given the inherent plurality of the Sunn? ethico-legal tradition, providing a comprehensive reading of all of the different opinions presented by ?anaf? jurists, both classical and modern, is not feasible. This piece instead outlines the dominant positions of leading authorities within the school and highlights several areas of contestation that remain part of the continuing ?anaf? discourse on the ethical and legal aspects of abortion. As there are many ethico-legal dimensions of induced abortion and it is not possible to analyze all of these in detail within the scope of the current work, the chapter focuses on the following interrelated questions: What is the legal status leading ?anaf? authorities assign to induced abortion? How does this status relate to timing of abortion? What are the criteria for determining when a fetus becomes a human being? Does the mother need the father’s permission for abortion? Does abortion have penal consequences? Is abortion in case of pregnancy from rape permissible? The discussion of these questions will be preceded by a brief description of the ?anaf? School and followed by a short evaluation of the arguments presented.

    [Book Review]: “The Logic of Law Making in Islam: Women and Prayer in the Legal Tradition”

    In this monograph, Sadeghi attempts to explain the legal thought of ?anafi jurists in the post-formative period, which he defines as “the period after the birth of the ?anafi legal tradition in the second/eighth century (p. 4).” The thesis of the book can be best summarized in his own words: “The reasons jurists give for the laws (“legal reasons”) adapt to accommodate the laws, and the laws adapt under the pressure of social conditions.” However, the default state is that laws do not change due to legal inertia.
