Mücbir sebep olarak COVID-19: Kamu ihale usul ve sözleşmelerine etkisi (2020/5 sayı ve COVID-19 salgınının kamu ihale sözleşmelerine etkisi konulu cumhurbaşkanlığı genelgesi ışığında bir değerlendirme)

Abstract

Covid-19 salgını, tüm dünyayı ve ülkemizi ciddi şekilde etkilemiş ve etkilemeye devam etmektedir. Covid-19 salgınının ortaya çıkması ile hayatın normal akışı etkilendiği gibi ticari hayat ve dolayısıyla ekonomik kamu düzeni de etkilenmiştir. Salgın ile mücadele, sadece salgının önlenmesi amacıyla değil ekonomik etkilerinin de iyileştirilmesi amacını içermektedir. Fakat bir mücbir sebep olarak Covid-19 salgını birçok hukuki ilişkinin temelini sarsmıştır. İçinde bulunduğumuz durum itibariyle de eski hale dönüşün belirsizliği ve sonuçlarının öngörülemezliği devam etmektedir. Bu nedenle, Covid-19 salgınının hem mevcut hukuki ilişkileri hem de gelecekteki hukuki ilişkileri etkiler nitelikte olduğunu söyleyebiliriz. Çalışma kapsamında, öncelikle Türk idare hukukunda mücbir sebep kavramı ve uygulamalarının yasal çerçevesi belirlenecektir. Daha sonra bu doğrultuda, mücbir sebep olarak Covid-19 salgınının kamu ihale sözleşmelerine etkisi ile kamu ihale usullerine etkisi esas olarak incelenecektir. Son olarak, salgın ile mücadele niteliğinde olan 2020/5 sayı ve “COVID-19 Salgınının Kamu İhale Sözleşmelerine Etkisi” konulu Cumhurbaşkanlığı Genelgesi kapsam, içerik ve etkileri açısından ele alınacaktır.

The Covid-19 outbreak has seriously affected and continues to affect the world and our country. With the emergence of the Covid-19 outbreak, the normal flow of life is affected, as well as the commercial life and hence the economic public order. Combating the epidemic includes not only the aim of preventing the outbreak but also the improvement of its economic effects. But the Covid-19 outbreak as a force majeure has put many legal relationships in crisis. The uncertainty of the reinstatement and the unpredictability of the consequences remain in the current situation. Therefore, we can say that the Covid-19 outbreak affects both current and future legal relationships. Within the scope of the study, firstly, the legal framework of force majeure concept and practices in Turkish administrative law will be determined. Then, in this direction, the effect of the Covid-19 outbreak on public procurement contracts and the effect on public procurement procedures will be mainly examined. Finally, the Presidential Circular No. 2020/5 entitled “The Effect of the COVID-19 Outbreak on Public Procurement Agreements” will be discussed in terms of scope, content and effects.
