Denizyoluyla yolcu taşıma sözleşmelerinde yolcuların taşıyanlara karşı korunması ve taraflar arasın daki dengenin gözetilmesi bakımından deniz yoluyla yolcu taşıma sözleşmeleri 2002 tarihli ‘‘Deniz Yoluyla Yolcuların Taşınmasına dair Atina Konvansiyonu” akdedilmiş ve uluslararası taşımacılık ile yeknesaklık sağlamak isteyen kanun koyucu Türk Ticaret Kanunu’nun 1247-1271 maddeleri arasında yer alan “Deniz Yoluyla Yolcu Taşınması” hükümlerini mezkûr Konvansiyon’dan almış ancak mülga kanun döneminde var olan “ölen yolcunun bagajının korunmasını düzenleyen” 1130. maddeyi karayoluyla yolcu taşımalarını düzenleyen m.915’e atıfla 6102 sayılı Kanun’a aktarmıştır. Bu çalışmada Mülga Kanun ile karşılaştırmalı olarak deniz yoluyla yolcu taşımalarında yolcunun taşınma esnasında ölmesi üzerine taşıyanın yolcu bagajı üzerindeki koruma yükümlülüğü incelenmiştir.
In order to protect the passengers against the carriers and to observe the balance between the parties in contracts of carriage of passengers by sea, the Athens Convention on the Carriage of Passengers by Sea dated 2002” was concluded and the legislator, who wanted to ensure uniformity with international transport, transferred the provisions of “Carriage of Passengers by Sea” between Articles 1247-1271 of the Turkish Commercial Code from the aforementioned convention. However, the legislator transferred Article 1130, which existed under the abrogated law “regulating the protection of the baggage of the deceased passenger”, to Law No. 6102 by referring to Article 915 regulating the carriage of passengers by road. In this study, the protection obligation of the carrier on the passenger baggage upon the death of the passenger during the carriage of the passenger in passenger carriage by sea is analysed in comparison with the abrogated law.
