Özet
Herhangi bir sebepten dolayı sona eren bir nikah akdinin ardından beklenmesi gereken süreyi ifade eden iddet, içerisinde birçok hikmeti barındıran bir zaman dilimidir. İslam hukukunda “iddet” olarak bilinen bu durum Türk Medenî Kanunu’nda “bekleme süresi” olarak ifade edilmektedir. İslam hukukunda ve Medenî Kanun’da iddetin mahiyeti ve amacı birçok açıdan farklılık arz etmektedir. Bu farklılıkların en önemlisi kaynak bakımından olup İslam hukukunda “iddet” olarak isimlendirilen bu zaman diliminin kaynağı Kur’ân-ı Kerîm’deki ilgili ayetler ve Hz. Peygamber (s.a.v.)’den rivayet edilen hadisler iken, Medenî Kanun’da ise “bekleme süresi” olarak adlandırılan bu sürenin kaynağı İsviçre Medenî Kanunu’dur. Diğer bir farklılık ise İslam hukukunda iddetin hem dünyevî hem uhrevî yönleri bulunurken Medenî Kanun’daki bekleme süresi ise sadece dünya hayatına yönelik hukukî bir durumu ifade etmektedir. Söz konusu farklılıklar iddetin ortaya çıkardığı hukukî sonuçları kimi zaman doğrudan etkilemektedir. İslam hukukunda iddet; boşanma, ölüm, hamile kadının ve kocası mefkûd (gaip) olan kadının iddeti gibi farklı çeşitlere sahiptir ve bu çeşitlere göre kadının iddet süresi farklılık göstermektedir. Bu doğrultuda İslam hukukunda genel anlamda sabit ve standart bir iddet süresinden bahsetmek mümkün değildir...
?Iddah, which expresses the period to wait after a marriage contract that ends for any reason, is a time period that contains many wisdoms. This situation, known as ?iddah in Islamic law, is referred to as "waiting period" in the Turkish Civil Code. The nature and purpose of ‘iddah in Islamic law and the Turkish Civil Code differ in many respects. One of the most important of these differences is the source of ?iddah in Islamic law and in the Turkish Civil Code. While the source of this period is the verses in the Qur'an and hadiths were narrated from the Prophet (PBUH) in Islamic Law, in the Turkish Civil Code, is the Swiss Civil Code. Another difference is that while there are both worldly and otherworldly aspects of ?iddah in Islamic law, the waiting period in the Turkish Civil Code only expresses a legal situation for worldly life. Having different approaches in terms of otherworldly and worldly, sometimes directly affects the legal consequences of ?iddah as discussed in more detail in the study. In Islamic law, there are different types of ?iddah such as divorce, death and birth, and the ?iddah of the absent husband (mafq?d), and according to these types, the ?iddah period of the woman differs. In this respect, it is not possible to talk about a fixed and standard period of ?iddah in Islamic law...
