dc.description.abstractBulunduğumuz yüzyılın bilişim çağı olarak adlandırılmasına binaen çağın en değer atfedilen unsurlarından birinin de veriler olduğunu ifade etmek yanlış olmayacaktır. Verileri bir araya getiren veri tabanları da önemi ile doğru orantılı şekilde yaygın olarak üretilmekte ve kullanılmaktadır. Veri tabanları, içindeki verilerden bağımsız derlemelerdir. Dolayısıyla bu derlemelerin de arka planındaki fikri güç yahut yatırım için bir koruma mekanizması öngörülmesi ehemmiyetlidir. Hukukumuzda, veri tabanları için FSEK kapsamında öngörülen koruma mekanizmaları, uluslararası fikri mülkiyet hukuku metin ve mevzuatlarını müteakiben getirilmiştir. Bu hukuki korumanın neler olduğu ve kapsamı bu çalışmanın konusunu oluşturmaktadır.
dc.description.abstractSince the current century is called the information age, it would not be wrong to state that one of the most valued elements of the age is data. Databases that bring data together are also widely designed and consumed in direct proportion to their importance. Databases are compilations independent of the data in them. Therefore, it is important to provide a protection mechanism for the intellectual effort or investment behind these compilations. In Turkish law, the protection mechanisms foreseen for databases within the scope of Code on Intellectual and Artistic Works numbered 5856 have been introduced following the international intellectual property law texts and legislations. The subject of this study is the nature and scope of the legal protection set forth for the databases.
