Bu Anlaşma, tanıma ve tenfiz konusunda yeknesak koşullar öngören çok taraflı bir uluslararası anlaşmadır. Bu çalışmada, Anlaşma’nın kapsamı ve yabancı mahkeme kararlarının tanınması ve tenfizine ilişkin koşullar incelenecektir. Ayrıca çalışmada, Türkiye’nin ileride bir âkit devlet olması durumuna istinaden, bazı öneriler de yer almaktadır. Bu çalışmada bütün bu beklentilerin, özünde bir varoluş mücadelesi ve asimilasyona dair kaygılar eşliğinde, yasal ve algısal boyutları olan bir tanınma mücadelesine dönüştüğü görülmektedir. One of these prohibitions mentioned in classical books is known that women cannot enter the mosque while they are menstruating. However, there are many fatwas given that women can enter the mosque when they are menstruating, especially today. In this paper, we investigate the question of the permissibility of entering a mosque for menstruating women according to Islamic law. Our paper consists of three main chapters. After establishing a general framework, in the second chapter, we will shortly discuss the positions of all four Sunni schools of law on this issue. Also in the second chapter, we will especially present the related opinions of the members of the Shafii school of law, as they include detailed issues in this regard and gave the basis for the fatwas given in the modern period. Finally, we will elaborate on the general framework and revisit contamporary positions with their supporting proofs and arguments. Bununla birlikte farklı analitik öncelikler doğrultusunda detaylandırılmış çeşitli argüman modelleri mevcuttur. Bu makale kavramsal ilişkilere odaklı karşılaştırmalı bir literatür taraması yöntemi ile söylem analizi çalışmalarını desteklemek amacıyla geliştirilmiş dört güncel argüman modelini karşılaştırmayı amaçlamaktadır: Toulmin Modeli, Pragma-Diyalektik, Politik Söylem Analizi ve Argüman Kaynakları Modeli. Argüman modelleri ve yaklaşımları bir yanda analizde içerik ve bağlamın önemine yaptıkları vurguyla söylemsel yaklaşımlardan, öte yanda belli akli ilişkileri ve standartları uygulamaya geçirmekle analitik felsefe ve mantıktan esin almışlardır. Argüman teorisi çerçevesinde önerilen dört modeli sırayla incelemeden önce argüman yaklaşımı söylem analizinin sosyal inşacı ve ampirik yaklaşımıyla, mantığın biçimsel ve normatif yaklaşımı arasında konumlandırılmaktadır. Ardından, söz konusu dört argüman modelinin gündelik iletişimdeki çıkarsama ilişkilerini apaçık etmek amacıyla, lakin farklı analitik ihtiyaçları göz önünde bulundurarak, bu ilişkileri nasıl farklı öğelere ayırdıkları irdelenmektedir. Dört bölüm boyunca basit bir gündelik argümanın her bir model tarafından ne şekilde yeniden yapılandırıldığı şematik olarak örnekleyerek gösterilmektedir. One of the waste elimination methods is assembly line balancing for lean manufacturing, i.e. Yamazumi. The assembly line balancing is to assign tasks to the workstations by minimizing the number of workstations to the required values. There should be no workstation with the excessively high or low workload, and all workstations must ideally work with balanced workloads. Accordingly, in this study, the axiomatic design method is applied for assembly line balancing in order to achieve maximum output with the installed capacity. In order to achieve this aim, all improvement opportunities are defined and utilized as an output of the study. Computational results indicate that the proposed method is effective to reduce operators’ idle time by 12%, imbalance workload between workstations by 38%, and the total number of workers by 12%. As a result of these improvements, the production volume is increased by 23%.Yayın Assessing the impact of financial obstacles on manufacturing firm's capacity utilization: Bayesian approach(University Indonesia, 2023) Hassan, Arab Dahir; Özcan, Rasim; Özcan, Rasim; İnsan ve Toplum Bilimleri Fakültesi, İktisat BölümüThis study investigates the relationship between financial obstacles and the capacity utilization of manufacturing firms. It departs from previous studies by employing a Bayesian linear regression analysis. The results demonstrate the considerable negative effect that financial constraints have on the capacity utilization of manufacturing enterprises, while access to credit lines has a positive ef-fect. The sample consists of 1,494 private manufacturing firms in 31 European and Central Asian countries. Financial obstacles were perceived as a major impediment to business operations by 65% of the enterprises surveyed. Furthermore, 52% of enterprises in the sample have access to loans from financial institutions, while 47% have no access to credit lines. This implies that the manufacturing sector’s capacity to tap into financial market resources and surmount financial barriers both is vital to its survival and presents a significant challenge.Yayın The attahashi family: the genealogy of the ruler of Sungai Iyu in aceh(SAGE, 2017) Özay, Mehmet; İnsan ve Toplum Bilimleri Fakültesi, Sosyoloji BölümüThe aim of this article is to present an analytical history of the Attahashi family of Turkish ancestry by illustrating its genealogy, whose members claim to be descendants of a Turkish ruler who is supposed to have arrived in Aceh in the late decades of the 16th or beginning of the 17th century. This attempt considers the connection to Sungai Iyu partly aligned with the eco-political developments in the 19th century and beginning of the 20th century. According to the argumentation of the current generation of the family, some individuals in the family became local rulers in Lam Kabeu and Sungai Iyu during the last century of the Sultanate of Aceh Darussalam. The relevant data, which sheds new light upon the traces of the Turkish existence in the region, has been acquired from various authentic written documents, oral information from various individuals including family members, and observations in field trips throughout the last decade. During the research, the author has put all his efforts to classify and comparatively examine the data from the various versions of relevant manuscripts, collected from Banda Aceh, Aceh Besar, Sungai Iyu and Medan, with each other.Yayın Attitudes of the mental health professionals towards unmodified and modified types of electroconvulsive therapy: A Turkey sample(Nobel, 2021) Akyüz Karacan, Fatma; Bağ, Sevda; Karacan, Murat; Yılmaz, Semra; Yanık, Medaim; Yanık, Medaim; İnsan ve Toplum Bilimleri Fakültesi, Psikoloji BölümüObjective: Electroconvulsive therapy (ECT) has been used frequently in the treatment of psychiatric disorders. By the year 2005, unmodified (without anesthesia) ECT started to be replaced by modified (under anesthesia) ECT. In this study, we aimed to evaluate the attitudes towards modified versus unmodified applications of ECT among the mental health professionals who experienced this transition period. Material and Method: Three subgroups of mental health professionals including psychiatric nurses, psychiatric trainees and psychiatrists who had at least 30 experiences of each ECT method, were asked to fulfill the semi-structured questionnaire. The questionnaire contained items related to participants’ attitudes towards each ECT method in terms of their efficacy, side effects, safety, satisfaction during application and their opinions about this transition to modified method. Results: In total, 54 (27.0%) psychiatrists, 82 (41.0%) trainees and 64(32.0%) psychiatric nurses were participated. In terms of efficiency, 53.7% of psychiatrists and 47.6% of trainees stated that the two ECT methods were equal. However according to 56.3% of psychiatric nurses unmodified ECT method was more effective than the modified one (χ2:10.615, p=0.031). Mental health professionals showed a common attitude towards the safety and satisfaction (for safety χ2:0.296, p=1.000 and for satisfaction χ2:1.987 p=0.778). For both safety and satisfaction all health professionals replied in favor to modified ECT applications. In all subgroups of professionals, according to majority of participants modified ECT method had less side effects (χ2:14.364, p=0.006) and reported positive opinion about the transition to the modified ECT applications (χ2:10.058, p=0.014). Conclusion: Mental health professionals had a positive attitude to the transition from unmodified to modified ECT and they found the modified ECT safer than unmodified one. Psychiatrists and psychiatric nurses were different in terms of their attitudes for the efficacy of ECT methods. © 2021, Nobelmedicus. All rights reserved.Yayın A benchmark modelling for participation-based tax increment financing(Emerald Publishing, 2020) Varlı, Yusuf; Övenç, Gökhan; Varlı, Yusuf; İnsan ve Toplum Bilimleri Fakültesi, İktisat BölümüPurpose – This paper aims to present the theoretical and conceptual framework of a new method in public finance called “participation based tax increment financing (P-TIF)” by combining conventional tax increment financing (TIF) within the Sharīʿah-compliance structure. Design/methodology/approach – This study develops a benchmark model for P-TIF, which offers a participative contract between both lender and borrower. With the help of this model, a financing schema in P-TIF is established by incorporating stochastic modelling. Possible implications and alternative options of application are also explored with a discussion of challenges. Findings – The results mainly indicate that P-TIF promises lenders to be a part of increment from tax earnings, in return for a reduced interest rate. They show how a rise in participation of the lender in a given contract lowers the interest rate. Under the base case scenario, the interest rate is reduced to zero when the participation of the lender in tax increment is set at 50%. Practical implications – With the feature of being interest-free, P-TIF can be implied also within the Sharīʿah-compliance framework, thanks to the model it is based on. Additionally, as the model in this paper is parametric, it can be applicable to various cases in Islamic finance. Originality/value – To the best of our knowledge, this is the first paper in the literature in the sense that it provides a conceptual idea and respective model for TIF method within a Sharīʿah-compliance framework.Yayın [Book Review]: "E. Drawing on the dynamic capabilities view, the present study examines brand management practices among firms in an emerging country. Drawing on a survey of 224 firms in Turkey, the study first aims to segment firms in terms of their adoption level of brand management practices and then relate them to their overall firm and brand performances. A three-cluster solution emerging from a K-means cluster analysis reveals that firms show significant differences with respect to both performance dimensions. The findings of the study also provide evidence to the view that brand management practices add to the dynamic capabilities of emerging country firms. Given the principle of extended producer responsibility, developing an effective reverse logistics network is the most significant digit ahead of the industry. However, initial attempts addressing the reverse logistics network design (RLND) problem were short-sighted, focusing on cost minimization. Undoubtedly, the whole concept of recycling was founded on the pillars of sustainability. Accordingly, reverse logistics network design must be motivated by long-term environmental and societal benefits. This fact has become even more prominent in the current pandemic environment as COVID-19 has added serious uncertainties and risks to the supply chain processes. This paper reiterates the essence of sustainability goals and proposes a multi-objective fuzzy mathematical model to RLND problem for ELVs under such a fragile and fuzzy environment. The coverage of the proposed model is to optimally determine the locations and numbers of the facilities and the flows among them concerning environmental, social, and economic aspects. Hence, the model aims to reach a robust compromise solution that leads to a resilient network design. A real case study on the ELV market in Istanbul/Turkey proves the merit of the developed model.
