Yayın [Book Review]: "Islamic Commercial Law - Contemporariness, Normativeness, and Competence"(İbn Haldun Üniversitesi, 2023) Mawejje, Jibril SwallehCommercial activities have always kept their importance in the history of humanity from ancient times to the present, with its function that accelerates the social transformation beyond meeting the physical needs of people, and in parallel with the radical changes in the production and consumption styles, conventional types of commerce have been subjected to radical changes throughout ages. It should not be difficult to guess that the attitude of the propositions of Islam on commercial law in the face of these changes is subject to some criticism. It is an exploitation of gullible and poor Muslims, an outdated system, a mere imitation trial of the conventional banking system, infeasible, non-normative, and so on, these are some of the criticisms that have been cast towards the Islamic commercial system, mainly from the western fraternity and the proponents of the conventional banking system. Therefore, this book’s relativity is in trying to assert the relevancy, competence, and feasibility of Islamic commercial law in the contemporary world of economics…Yayın The role of presumption in affirmation of punishment for inebriety(İbn Haldun Üniversitesi, 2023) Mawejje, Jibril Swalleh; Lisansüstü Eğitim Enstitüsü, Temel İslam Bilimleri Ana Bilim DalıGiven the tragedies and absurdities caused by inebriety, different strategies are laid by different legal frameworks to enforce rules intended to curb its negative repercussions. There is a need for approaches to affirm drunkenness. Among these approaches is using presumptions to prove or disapprove of inebriety. Therefore, this paper's relevancy lies in postulating the roles of presumptions in affirming the crime of inebriety and its respective prescribed punishment in the Islamic criminal courts. By scanning various Islamic jurisprudence literature and previous academic articles concerning presumption in Islamic law and critical analysis of them, this paper was put together to target a specific aspect of presumption effect in Islamic criminal law: inebriety. The paper illustrated that even though Presumptions may not yield irrepealable proof, they might have legal implications in the Islamic courts of law.
