Türk hukukunda acentenin tahkim sözleşmesi akdetme yetkisi

Bağımsız tacir yardımcılarından olan acente, 6102 sayılı Türk Ticaret Kanunu (TTK) m. 105 hükmü gereği kurulmasına aracılık ettiği ya da müvekkili adına yaptığı sözleşmelerle ilgili hakkı koruyucu beyanları müvekkili adına yapmaya ve bunları kabule yetkili olduğu gibi bu sözleşmelerden doğan uyuşmazlıklarda müvekkilini mahkemede temsile de yetkilidir. Bir yargılama faaliyeti olan tahkimde acentenin müvekkilini temsil için tahkim sözleşmesi akdetme yetkisinin bulunup bulunmadığı sorusunun, acentelik faaliyeti kapsamında gerçekleştirilen işlemlerin ticari nitelik taşıması ve ticari yargılamaların tahkim yoluyla çözülmesi eğiliminin artması nedeniyle cevaplanması şarttır. Çalışmamız Türk hukuku ile sınırlandırılmış olup bu bağlamda öncelikle acentenin yetkileri genel hatları ile ele alınacak, bu yetkilerden biri olan sözleşme akdetme yetkisi dahilinde acentenin tahkim sözleşmesi akdetmeye ehil olup olmadığı, acenteye müvekkili tarafından özel bir yetki verilip verilmemesine göre incelenecek, son olarak acentenin müvekkilini tahkim yargılamasında temsili meselesi tartışılacaktır.

ELI Guidance On Company Capital And Financial Accounting For Corporate Sustainability is important as it draws attention to the importance of company equity in achieving corporate sustainability and provides guidance to companies in this direction. This study aims to introduce Turkish Law by comparing this Guideline, which contains guiding recommendations for the establishment of corporate sustainability and the use of companies' equity in this direction, with the regulations on reserves and profit distribution in Turkish Law.
1989 kurtarma sözleşmesi̇ne göre kurtarmanın tanımı ve unsurları ile kurtarmaya ili̇şki̇n bazı hükümler

Kurtarma faaliyeti, deniz kazaları içerisinde önemli bir yer oluşturmaktadır. Kendi karasularında veya uluslararası sularda (deniz alanlarında) seyreden gemiler çeşitli nedenlerle kurtarmaya ihtiyaç duyarlar. Bu sebepler arasında; karaya oturma, ana ve yardımcı makine arızası, dümen arızası nedeniyle durma ya da çatma, sürüklenme ve yangın gibi nedenler sonucu, geminin seyrine devam etmesinde aciz kalması gibi olaylar başta gelmektedir. Kurtarma faaliyetine, kurtarmaya dair Türk Ticaret Kanunu hükümleri ile uluslararası sözleşmelerin hükümleri uygulanmaktadır. Çeşitli hukukî ve teknik gelişmeler sebebiyle, 1910 Sözleşmesinin hükümleri yetersiz kalmıştır. Bu nedenle, uluslararası çalışmalar yürütülmüş ve sonuçta 1910 özleşmesinin yerine geçmek üzere 28.04.1989 tarihinde Londra’da, Denizde Kurtarma Hakkında Milletlerarası Sözleşme “International Convention on Salvage (SALVAGE 1989) kabul edilmiştir. Türkiye’nin de tarafı bulunduğu bu Sözleşme hükümleri Türk Ticaret Kanunu’na da kaynak olması açısından önemlidir. Bu çalışmada kurtarmanın tanımı ve unsurları incelenecek olup deniz kamu hukuku konuları ile cezai hükümler incelenmeyecektir.
Monitoring: Reasons and strategies

Monitoring students is an essential part of the task cycle, which starts with a short introduction to the task along with instructions. Then the teacher usually monitors students while completing the task before conducting feedback. Monitoring students while completing a task is crucial if it’s conducted appropriately. In training courses such as the CELTA and CertTESOL, I have noticed that trainees may over-monitor students and engage with them during the task, turning the monitoring into counterproductive interference. They may also be unaware of what to do exactly while monitoring students during different stages of the lesson. Masculinity aloft and on the ground: The myth of warrior nation in Turkey's Cold War cinema

This article explores the construction of militarized masculinity and nationalist myths in Turkish Cold War cinema of the 1960sthrough a comparative analysis of two films: On Korkusuz Adam (Ten Fearless Men, 1964) and Göklerdeki Sevgili (The Lover inthe Skies, 1966). Produced and circulated in a period of political realignments as a response to the Cold War and the Cyprusconflict, these films played a role in the popularization of the myth of warrior nation. Hence, relying on theories on theformulation of political myths and gendered nationalism, this study shows how the representation of the Cyprus conflictworked to justify national superiority and heroism of Turks. Close reading and contextual film analysis reveal that these films donot merely reproduce the official nationalist discourse, but they actively shape militarist discourses by inviting viewers to alignwith the Turkish hero's point of view. Furthermore, the study inserts the films into a broader Cold War cultural corpus throughestablishing parallels with American and South Korean examples. In doing so, it deepens the analysis of the relationship be-tween politics and culture by stating what role globally played by Turkish cinema in the production and popularization of themyth of warrior nation.
